Operation Consent Agreement Form
This EULA is an agreement between you and Toshiba Corporation (hereafter Toshiba).
This EULA applies to the accompanying Software produced by Toshiba.
- License Grant
This Software can be used only by the owner of Toshiba USB Flash Memory. You are not allowed to copy, redistribute, license or sub-license this Software. If you do not own Toshiba USB Flash Memory, then you are not allowed to download, install, copy or use this Software.
- Rights of Use
Toshiba grants you a nontransferable and nonexclusive right to use this Software. You are allowed to use this Software only with Toshiba USB Flash Memory. You are not allowed to copy documents related to this Software. You are not allowed to change, translate, rent, copy or transfer part or all of this Software or the rights granted by this EULA. You are not allowed to remove proprietary notices, labels, trademarks or other marks that are on this Software. You are not allowed to create derivative work based on this Software. However, you may permanently transfer all of your rights under this EULA, provided you retain no copies, you transfer all the Software, and the recipient agrees to the terms of this EULA.
- Copyright
This Software is licensed, not sold. You acknowledge that no title to the intellectual property in the Software is transferred to you. You further acknowledge that title and full ownership rights to the Software will remain the exclusive property of Toshiba, and you will not acquire any rights to the Software, except the license expressly set forth in this EULA.
- Reverse Engineering
You agree that you will not reverse engineer, reverse compile, modify, translate, or disassemble the Software in whole or in part. If you are a business, then you must have your employees strictly adhere to this EULA.
- Warranty
Toshiba does not warrant this Software or its merchantability or fitness for a particular purpose.
- Limitation of Liability
Toshiba bears no responsibility for loss to you caused by the operation or lack of operation of this Software.
- Export Laws
If you attempt to export or carry this Software out of the country, you must receive permission from the Japanese government in accordance with the 'Foreign Exchange and Trade Law' and related regulations.
- Severability
If you breach any part of this EULA, Toshiba maintains the right to immediately dissolve this EULA. In this situation, you must destroy this Software.
